The troubled starlet, who's still in treatment, missed her scheduled court date Tuesday because she's not mentally fit to stand trial, according to her lawyer It looks Amanda Bynes won't be checking out of UCLA's psych ward anytime soon.

The troubled starlet was due to appear in court Tuesday for a hearing on her DUI arrest back in 2012, but didn't show up.

According to her lawyer, the 27-year-old is mentally unfit to attend because she doesn't have the capacity to understand what's going on. Amanda's been hospitalized on a mandatory 5150 psychiatric hold since she randomly started a fire in someone's driveway on July 22.

Her case will get transferred back to the mental health court, where the judge will conduct a hearing to determine her mental capabilities.

A new court date for her DUI arrest was set for January 2014.

Amanda is still getting in-patient treatment and under a conservatorship her mom was granted in August.
