Hershey Suing Over Pot Candy: Medical Marijuana Company Responds

The Hershey company is suing mad over some familiar sounding candy items that just happen to contain marijuana.

Obviously Hershey doesn't want to be associated with the pot candy. Plus there's that whole copycat vibe, as the famous chocolate company has filed two trademark infringement complaints because the TinctureBelle company's packaging looks oh-so-similar to some of Hershey's bestsellers.

TinctureBelle's products include Reefer's cup and Kush cup, Mr. Dankbar, Ganja Joy, Hashees and Hasheath. Among the complaints, Hershey noted that the similarities in name and packaging could be confusing and someone could "inadvertently ingest" the pot candy.

TinctureBelle is firing back, with President Char Mayes releasing a statement explaining that they changed their packaging months before the Hershey people filed suit: "The lawsuit from Hershey came as a huge surprise to us. Because we changed our entire label line approximately 6 months ago, long before these allegations surfaced last week. Our new packaging looks nothing like Hershey's or anyone else's."
