The singer instructed her lawyers to fire off a cease and desist letter to Wimo Labs bosses last month, claiming their product's name, TikTok, was in "flagrant and conscious disregard" of her rights.

Wimo Labs executives have now hit back and this week filed papers requesting a federal court in Chicago to declare their TikTok watch strap does not constitute an infringement of Ke$ha's copyright, because consumers are unlikely to associate the star with the product.
